However, we find it important to inform you about the way in which you can use the Leadlife Webshop on the Leadlife Website and the Services, Products and Courses offered there.

That's why we've created this 2-minute summary for you. This summary will give you the information you need in no time and inform you about everything you need to know.

First of all, what is Leadlife?

  • Leadlife offers you a digital platform to improve your quality of life. This is made available to you via the subscription you have chosen within the mobile application (hereinafter: 'Leadlife Application') and a personal dashboard generated thereon. Via the Leadlife Application and the Leadlife Webshop on the Leadlife Website (hereinafter: 'Leadlife Webshop'), Leadlife offers Services, Products and Trajectories via itself, Leadlife BV, Leadlife Partners or via independent Healthcare Practitioners and (professional) Healthcare Practitioners, all of which allow you to optimally manage and improve your well-being and lifestyle. You can find and - where applicable - purchase these Services, Products and Trajectories in our Leadlife Webshop and in the Leadlife Catalog in the Leadlife Application.
  • These General Terms and Conditions only apply to the Leadlife Webshop.

 

When can you PURCHASE the services, products and courses?

  • The Services, Products and Courses that Leadlife offers can be purchased via the Leadlife Webshop on the Leadlife Website (as well as in the Leadlife Catalog in the Leadlife Application). These General Terms and Conditions apply to purchases in the Leadlife Webshop. For purchases within the Leadlife Application, you must consult the general terms and conditions of the Leadlife Application.

 

 

 

  • Before you can proceed to purchase Services, Products and Courses within the Leadlife Webshop, you must accept these General Terms and Conditions and our Privacy Statement of the Leadlife Webshop. Once you have completed the purchase, you will receive a code for Services, Products and Courses that you must enter in the Leadlife Application in order to gain access to your purchased Products, Services and Courses. Depending on the Product, the relevant Product may also be sent to you or made available to you if you do not first have to activate this Product via the Leadlife Application using a code. If you want to know how to use the Leadlife Application, you should consult the General Terms and Conditions for the Leadlife Application.
  • Within the Leadlife Webshop you can purchase Services, Products and Courses from Leadlife, Leadlife BV, and Leadlife Partners.
  • For each of the Services, Products or Routes offered, you will find on the relevant Product, Service or Route page, among other things, a Technical Data Sheet with a more detailed description of the Product, Route or Service in question.
  • For each of the Services, Products or Courses offered by a Partner, the Technical Sheet will also contain the relevant general terms and conditions of Leadlife BV or the Leadlife Partner, as well as any additional terms and conditions. An extract of the Partner's general terms and conditions, as well as other information that you should take into account, can be found on the Partner page.
  • If you have purchased a Service and/or Course, depending on the Service and/or Course you have purchased, the guidance will take place either online, in a Leadlife centre or at a location of one of our Partners.
  • If you would like more information about the Services, Products and Courses on the Leadlife Webshop, you can make an appointment via the Leadlife Website or contact a Leadlife centre by telephone for a no-obligation consultation. This consultation can take place both physically and online. In order to register for such an introductory consultation, you must be at least 18 years old and you must provide us with certain personal information in advance. There is no obligation to purchase as a result of an introductory consultation.

How can you use the Services, Products and routes? 

  • You may use the Services, Products and Courses only as intended. You and we are jointly responsible for the confidentiality of your use.
  • The use of Services, Products and/or Courses of Leadlife or Leadlife BV will always take place in accordance with what is described in the general terms and conditions of the Leadlife Application.
  • The use of Services, Products and/or Courses of Leadlife Partners will always take place in accordance with an extract of the general terms and conditions of Leadlife BV and the Leadlife Partner that is made available via the Partner page for the relevant Services, Products and Courses. On this Partner page you can also find a reference to the full general terms and conditions and the contact details of the Partner in question.
  • Leadlife has a quality protocol for concluding a collaboration with Leadlife BV as well as with a Leadlife Partner, on the basis of which the services of Leadlife BV and the Leadlife Partners will be subject to a quality control before this Partner can offer Services, Products and Courses within the Leadlife Webshop.
  • If you violate our Terms and Conditions, you risk being banned from using the Services, Products and Courses.

Also important to know 

  • The Personal Data that you share with us always remains your property and you alone determine who has access to your Personal Data. Leadlife will only use this to provide its Services, Products or Trajectories to you. For the Services, Products and Trajectories of Leadlife BV and Leadlife Partners that you purchase via the Leadlife Webshop, you retain the choice at all times about which Personal Data you wish to share with this Partner.   • Leadlife, its subcontractors, Leadlife BV and Leadlife Partners always remain the owner of their Services, Products and Courses and of all related intellectual property rights.
  • Leadlife can only be held liable for damage that is directly attributed to Leadlife and Leadlife alone.
  • Every Healthcare Practitioner and (professional) Healthcare Practitioner who is directly or indirectly responsible for (part of) the Services relating to Services, Products or Trajectories, remains at all times liable for his/her professional activities and the delivery of these Services, Products and Trajectories, in accordance with their relevant terms and conditions.
  • Our Terms and Conditions may be updated from time to time. We recommend that you check them regularly, but we will of course always inform you of any changes, whereby you can freely decide whether you continue to use the Leadlife Webshop.

Article 1. General

The Terms and Conditions are offered electronically. A printed version of the Terms and Conditions is available upon request via info@leadlife.com .

The Leadlife Webshop is fully operated and the Services, Products and Courses are operated and sold (distributed) by Leadlife Technologies (hereinafter: 'Leadlife') .

The Leadlife Webshop offers Services, Products and Courses from Leadlife, Leadlife Partners and Leadlife BV, with Leadlife BV being the preferred partner.

In order to purchase and use Services, Products and Courses from Leadlife, Leadlife BV and Leadlife Partners in the Leadlife Webshop, Customers must accept the General Terms and Conditions and the Privacy Statement prior to purchase.

It is recommended that the Customer carefully reads the General Terms and Conditions and the Privacy Statement before purchasing Services, Products and Courses in the Leadlife Webshop .

Article 2. Definitions

In these General Terms and Conditions, the terms below have the meaning stated next to them.

 

 

General Terms and Conditions

These general terms and conditions govern the sale and use of the Services, Products and Courses of Leadlife, Leadlife BV or Leadlife Partners in the Leadlife Webshop.

 

Leadlife Application

The Leadlife platform, its associated interfaces and basic functionalities, offered in an application downloadable via iOS and Android;

 

Leadlife

Being Leadlife Technologies, the company under Belgian law, with registered office at 8900 Ieper, Zwaanhofweg 10, and registered with the Crossroads Bank for Enterprises under number 0834.079.442 , which operates the Leadlife Webshop and the Services, Products and Trajectories offers itself, Leadlife BV or other Leadlife Partners on the Leadlife Webshop in the capacity of distributor;

 

Leadlife BV

Being Leadlife BV, the company under Belgian law, with registered office at 8900 Ieper Zwaanhofweg 10, and registered with the Crossroads Bank for Enterprises under number 737.913.939, which, as a preferred partner of Leadlife, offers Services, Products and Courses on the Leadlife Webshop;

 

Customer

Any customer who wishes to purchase Services, Products and Courses in the Leadlife Webshop; 

 

Leadlife Webshop

The range of Services, Products and Courses available on the Leadlife Website from Leadlife, Leadlife BV and Leadlife Partners;

 

Leadlife Website

The Leadlife website on which Services, Products and Courses are offered on the Leadlife Webshop, being https://www.leadlife.com/ .

 

Services

The full range of services within the Leadlife Webshop from Leadlife, Leadlife BV or Leadlife Partners;

 

Products

The complete range of products within the Leadlife Webshop from Leadlife, Leadlife BV or Leadlife Partners;

 

Trajectories

The full range of courses within the Leadlife Webshop from Leadlife, Leadlife BV and Leadlife Partners, which may consist of a combination of different Products and/or Services;

 

Technical Data Sheet

The Technical Sheet is a digital sheet linked to a Service, Product or Route that can be found on the Leadlife Website, linked to the relevant Service, Product or Route. It enables the Customer to obtain information in an accessible and unambiguous manner about the specifications of a Service, Product or Route of Leadlife, Leadlife BV or a Leadlife Partner. The Technical Sheet forms an integral part of the purchase contract that is concluded between the Customer and Leadlife or Leadlife BV or, where applicable, the Leadlife Partner when purchasing a Service, Product or Route by the Customer;

 

(Leadlife-) Partner

Any natural person or legal entity that does not have the capacity of a Customer, that is not Leadlife or Leadlife BV, but that does offer Services, Products or Courses via the Leadlife Webshop on the Leadlife Website;

 

Partner Page

A page on the Leadlife Website where the Customer can easily consult additional information regarding the Partner. This page contains the Partner's contact details, an extract of the Partner's general terms and conditions and any other information that may be useful to the Customer in connection with the Services, Products or Trajectories offered by the Partner;

 

Third party(ies)

Any natural person or legal entity that is not a Customer or that is not Leadlife, Leadlife BV or a Leadlife Partner;

 

Healthcare practitioner

Any professional referred to in the coordinated law of 10 May 2015 on the practice of healthcare professions;

 

(Professional) Healthcare Practitioner

Any natural person who provides care on a professional basis, including a professional who is not a health care practitioner;

 

Intellectual Property Rights

All now known or hereafter acquired (i) copyrights, neighbouring rights and moral rights, (ii) trademark or service mark rights, (iii) trade secret rights, know-how, know-how, (iv) patents, patent rights and industrial property rights, (v) layout design rights, design rights, (vi) supplementary protection certificates, (vii) trade and business names, domain names, database rights, lease rights and all other industrial intellectual property rights or similar rights (whether registered or unregistered), (viii) all registrations, applications for registration, renewals, extensions, divisions, improvements or reissues in respect of these rights and the right to apply, maintain and enforce any of the foregoing, in each case and in any jurisdiction worldwide, for as long as such protection lasts;

 

AVG

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, also known as the General Data Protection Regulation;

 

Personal data

Any information relating to an identified or identifiable natural person;

 

Privacy Statement

Leadlife's privacy statement regarding the data processing of data subjects in the context of the Leadlife Webshop offered by it and the Services, Products and Courses offered therein;

 

Agreement

The present agreement concluded between Leadlife and the Customer on the basis of these General Terms and Conditions;

 

Consumer

The natural person who is not acting in the exercise of his professional activity or a business;

 

Sampling kit

The medical devices (for in vitro diagnostics) offered to the Customer by Leadlife in the context of, among other things, cortisol, melatonin and DNA measurements;

 

Article 3. Subject  

3.1   These General Terms and Conditions apply to the sale of the Services, Products and Courses of Leadlife, Leadlife BV and Leadlife Partners in the Leadlife Webshop. Furthermore, these General Terms and Conditions also apply to every purchase order and to all deliveries. 

3.2    All information regarding Leadlife's subscription formulas (Memberships) is described in the general terms and conditions of the Leadlife Application.

3.3   To use Services, Products and Courses offered in the Leadlife Webshop, the Customer must be at least 18 years old. Damage (whether direct or indirect), resulting from the (unlawful) use by a minor Customer, cannot be recovered from Leadlife. The Leadlife Application is only available in Belgium .

3.4    The Services, Products or Trajectories include, but are not limited to, the Collection Kits, individual expert sessions, digital intakes, subscriptions,

Article 4. Purchase order, acceptance and payment

 

4.1  General terms and conditions regarding purchases in the Leadlife Webshop

4.1.1   Leadlife reserves the right – within the legal framework – to inquire whether the Customer can meet its payment obligations, as well as all facts and factors that are important in the context of the execution of the purchase order. If, based on this investigation, Leadlife has valid reasons not to accept the purchase order, Leadlife is entitled to refuse a purchase order or to attach special conditions to the execution.

4.1.2   The Customer is obliged to report any inaccuracies in the payment details provided or stated to Leadlife without delay. Leadlife will take appropriate technical and organizational measures to secure the transfer of data and, if applicable, will ensure a secure web environment. If the Customer pays electronically, Leadlife will take appropriate security measures to that end.

 

4.2  Purchase of Services, Products and Courses from Leadlife and Leadlife BV via Leadlife  

4.2.1   Via the Leadlife Website, the Customer has access to the Leadlife Webshop. Within this Leadlife Webshop, the Customer will be allowed to purchase via Leadlife: in addition to the Services, Products and Trajectories of other Partners and possibly Leadlife itself, the Services, Products and Trajectories of Leadlife BV. The cost price for and associated with a Product, Service or Trajectory of Leadlife and Leadlife BV is always clearly displayed in the Leadlife Webshop. In addition, for each Product, Service and Trajectory of Leadlife and Leadlife BV, all facilities and modalities that are included in the relevant Product, Service or Trajectory will always be clearly displayed. The memberships can - where indicated - also be obtained by purchasing Products, Services and Trajectories.

4.2.2    The prices shown are shown in euros and are always the unit price for the Product, Service or Route in question.

4.2.3   The prices shown for the Services, Products and Courses of Leadlife (if any), Leadlife BV and other Leadlife Partners are exclusive of any laboratory costs and the costs that may be charged to the Client by a Healthcare Practitioner and/or a (professional) Healthcare Practitioner who must be consulted in the context of the selected case. Such costs are determined autonomously by the laboratory and/or the Healthcare Practitioner or the (professional) Healthcare Practitioner and must be paid separately to the respective actor. Healthcare Practitioners and (professional) Healthcare Practitioners will always determine their fees in accordance with the Code of Medical Ethics. Leadlife will always do what is necessary to Services, Products and/or Courses of Leadlife and Leadlife BV to clearly and unambiguously indicate when the aforementioned additional costs may apply.

4.2.4   The purchase of the Services, Products and/or Courses of Leadlife (if any), Leadlife BV and other Leadlife Partners that are offered within the Leadlife Webshop, is done via Leadlife.

4.2.5    Before proceeding to effective payment of his Service, Product or Course from Leadlife (if any), Leadlife BV and other Leadlife Partners, the Customer will receive a clear overview of the price to be paid, as well as the conditions associated with the purchase and any additional modalities and/or facilities specific to the purchased Product, Course or Service from Leadlife (if any), Leadlife BV and other Leadlife Partners. By proceeding to the effective payment module, the Customer explicitly agrees to the purchase order, as well as to these General Terms and Conditions, which also regulate the purchase and use of the Services, Products and/or Courses from Leadlife and Leadlife BV. More information about the right of withdrawal that applies to this Agreement can be found in article 7 of these General Terms and Conditions.

4.2.6   Leadlife reserves the right to correct any errors in stated prices without incurring any liability.

4.2.7   The following payment methods are accepted, insofar as they are permanently supported by the payment provider: Bancontact, Visa, MasterCard, Maestro, American Express, Paypal, Belfius Direct Net, KBC/CBC Payment Button and ING home'Pay. Payments are made via Shopify (and the payment facility Mollie included therein). Leadlife will not receive direct payments from the Customer.

4.2.8   In addition to purchasing Services, Products and Courses from Leadlife and Leadlife BV via the Leadlife Webshop, the Customer can also purchase Services, Products and/or Courses via the Leadlife Catalog in the Leadlife Application. The general terms and conditions of the Leadlife Application apply to this.

        

4.3  Purchase of Services, Products or Courses from Leadlife Partners  

4.3.1    Within the Leadlife Webshop, the Customer has the option to purchase Services, Products and Courses from Leadlife Partners.

4.3.2    Leadlife has a quality protocol for concluding partnerships, on the basis of which Partners will be subject to a quality control before they can offer Services, Products and Courses within the Leadlife Webshop.

4.3.3    For the Services, Products and Trajectories of Leadlife Partners, a clear description of the modalities and facilities will always be made available on the Technical Data Sheet. For each Leadlife Partner, an extract of their general terms and conditions, a reference to the general terms and conditions and contact details will also be made available on the Partner page of the Leadlife Partner on the Leadlife Website. The aforementioned extract is intended to inform the Customer in an accessible and unambiguous manner about any deviations from the general terms and conditions of the Partner compared to these General Terms and Conditions. The Customer will be given the opportunity to consult the full general terms and conditions of the Partner in a simple and accessible manner.

4.3.4    The purchase of the Services, Products and/or Courses of a Leadlife Partner that are offered within the Leadlife Webshop is done via Leadlife.

4.3.5    The Client must contact a Partner for the delivery, execution, modification, cancellation, questions regarding the cost price of the Services, Products and Courses of a Partner via the contact details provided on the Partner page. Leadlife acts with regard to the Services, Products and Courses of a Leadlife Partner solely from a distributive, at most minimal facilitating role.

Leadlife cannot be held liable for errors in any data provided by the Partner to Leadlife (see Article 12). The Customer should also contact the Partner in question for substantive support questions regarding the personalized or non-personalized Services, Products and Courses of a Leadlife Partner. The Customer can only contact Leadlife via support@leadlife.com for questions of a technical nature relating to the Leadlife Webshop .

4.3.6    The prices shown are always shown in euros and are always the unit price for the specific Product, Service or Course of the Leadlife Partner.

4.3.7    Before proceeding to effective payment of his Service, Product or Course, the Customer will receive a clear overview of the price to be paid from a Leadlife Partner, as well as the conditions associated with the purchase and any additional modalities and/or facilities specific to the purchased Product, Course or Service. The General Terms and Conditions of the Leadlife Partner may not be more stringent than that stipulated in these General Terms and Conditions, unless otherwise stipulated in the General Terms and Conditions of the Leadlife Partner. The Leadlife Partner will always clearly inform the Customer of the scope of the more stringent nature of such conditions. By proceeding to the effective payment module, the Customer explicitly agrees to the purchase order, the General Terms and Conditions and Privacy Statement of Leadlife and the general terms and conditions, any privacy statement and/or additional conditions of the Leadlife Partner. More information about the right of withdrawal that applies to this Agreement can be found in article 7 of these General Terms and Conditions.

Article 5. Delivery

5.1   Leadlife will carry out the delivery of the Services, Products and Courses with care, to the extent that it is responsible for the delivery.

  • If this is the case, Leadlife will, with or without Leadlife BV and/or a Leadlife Partner, execute the delivery with appropriate speed. Any delivery times stated by Leadlife BV are merely an indication, and therefore no rights can be derived from them by the Customer.
  • If this is not the case, Leadlife will ensure that Leadlife BV or the relevant Leadlife Partner carries out the delivery carefully and with due haste.

 

 

 

 

5.2   Delivery of the Products of Leadlife and Leadlife BV, in particular the Collection Kit(s) and Products of Leadlife Partners

5.2.1    The place of delivery of the Products of Leadlife or Leadlife BV is agreed between Leadlife/Leadlife BV and the Customer via the channels provided for this purpose. The place of delivery of the Products of Leadlife Partners are communicated via the Technical Data Sheet of the relevant Product, or via the Partner page.

5.2.2    Leadlife and Leadlife BV are deemed not to be responsible for the consequences of the communication of incorrect data by the Customer. If the delivery address provided is incorrect or incomplete and a Product of Leadlife or Leadlife BV (including the Collection Kits) or a Product of a Leadlife Partner needs to be sent again, additional costs will be charged to the Customer.

5.2.3.   The following delivery methods are proposed by Leadlife for the delivery of Products of Leadlife and Leadlife BV: delivery of the Collection Kit to a delivery address specified by the Customer, to a BPost collection point, to a BPack collection point, to a Leadlife center collection point or to a Partner selected by Leadlife. The Collection Kits are only delivered in Belgium.

5.2.4.   For the delivery of Products from Leadlife Partners, the delivery methods and delivery conditions are stated on the Partner page.

5.2.5    The risk is transferred to the Customer at the time of unloading of the Leadlife or Leadlife BV Product by the carrier, forwarder or other person employed. If the Leadlife or Leadlife BV Products were delivered damaged, article 6 of these General Terms and Conditions must be followed. For the warranty conditions for the Leadlife-Partner Products, the Customer can go to the Partner page of the relevant Partner.

5.2.6    The Products will be delivered to the delivery address specified by the Customer. If no one is present to receive the Product at the time of delivery, a delivery notice will be left. This delivery notice will state the postal address where the Customer can collect the Product. The Product will remain available to the Customer at the postal address for fourteen (14) days after the day of delivery. After this period, the purchased Product will, where applicable, be returned to Leadlife, Leadlife BV or the relevant Leadlife Partner. In that case, the Customer can contact Leadlife, Leadlife BV or the relevant Leadlife Partner in order to arrange a new delivery at the Customer's expense.

Delivery of the purchased Product will take place no later than twenty (20) working days after acceptance of the purchase order, unless a longer delivery period has been indicated.

5.2.7    If the desired Product from Leadlife or Leadlife BV is not in stock, Leadlife and Leadlife BV will make every effort to make it available again. Leadlife and Leadlife BV will inform the Customer by e-mail of the (temporary) unavailability of this Leadlife Product, at the latest within fourteen (14) days after placing the purchase order. The Customer has the choice to wait for the availability of this Product from Leadlife or Leadlife BV and/or to cancel the purchase order without additional costs. The Customer can find more information about the Products of Leadlife Partners on the Partner page. 

In the event that the Customer chooses to await the availability of this Product from Leadlife or Leadlife BV, this Product will be shipped as soon as it is available again. If the Product is not (any longer) available or the Customer chooses to cancel the purchase order, Leadlife or Leadlife BV will refund the Customer for the price of the Product in question, within thirty (30) days after the Customer has reported this choice to Leadlife.

5.3 Delivery of the Services and/or Trajectories of Leadlife and Leadlife BV and Services and/or Trajectories of Leadlife Partners

5.3.1    If the Customer purchases a Service and/or Course via the Leadlife Webshop, the Customer will receive an activation code to activate the Services and/or Courses purchased by him in the Leadlife Application.

5.3.2    The Customer acknowledges that the provision of the Services is subject to any waiting times at the location where Services are offered, together with the Customer’s availability to make an appointment to use the Services. The Customer also acknowledges that the Provision of the Services may be subject to the availability of the Healthcare Practitioners and/or (professional) Healthcare Practitioners. For questions regarding the Provision of Services by Leadlife Partners, the Customer should contact the relevant Leadlife Partner using the contact details provided on the Partner page.

5.3.3    The Services of Leadlife and Leadlife BV do not provide medical care and are in no way intended to replace any form of medical care. The purpose of the Services is to help the Client understand their lifestyle and well-being and does not provide diagnoses for diseases or conditions. If the Client suspects a medical emergency, they should immediately contact their Healthcare Practitioner, (professional) Healthcare Practitioner or the emergency services.

5.4 Late cancellation of a delivery of a Product or Services of Leadlife and Leadlife BV by the Customer or a 'no-show' by the Customer and late cancellation of Products and Services of Leadlife Partners.

5.4.1    The Customer must cancel an appointment at least 48 hours in advance. This applies to appointments made (physical or online) within Leadlife and Leadlife BV with either a Healthcare Practitioner or a (professional) Healthcare Practitioner. If the Customer decides to cancel within 48 hours before the actual appointment, does not show up at the agreed time or is absent more than twenty minutes after the start of the scheduled appointment, no reimbursement of costs already incurred can be provided to the Customer. In the event of late attendance, Leadlife or Leadlife BV also reserves the right to cancel the appointment itself. The Customer can make a new appointment, although the costs for this additional or new appointment will be for the Customer.

5.4.2    In the event that Leadlife has to cancel an appointment (physical or online) of a Customer with a Healthcare Practitioner or a (professional) Healthcare Practitioner within 48 hours prior to the appointment, the Customer will be offered the option of a refund of the costs already incurred by the Customer for this specific appointment, or the option of booking a new appointment, in which case the costs for booking this new appointment will be borne by Leadlife or Leadlife BV, if applicable. Leadlife and Leadlife BV reserve the right to deviate from the cancellation policy with reimbursement of costs if the cancellation of a Healthcare Practitioner or a (professional) Healthcare Practitioner arises from a situation in which the Healthcare Practitioner or a (professional) Healthcare Practitioner has been called in for an urgent intervention or is absent due to an accident or other force majeure situation.

5.4.3    Customer acknowledges that cancellation policies for Leadlife Partner Products and Services may vary depending on the policy of the Leadlife Partner in question. Leadlife Partner cancellation policies can be found on the Partner page of the specific Leadlife Partner.

Article 6. Warranty and conformity

6.1   Information, images, oral statements, specifications, etc. with regard to all offers and the most important characteristics of the Services, Products and Courses that are provided by telephone, by e-mail, by (info)brochure or online via the website www.leadlife.com or the Leadlife Website, are given or made as accurately as possible. Leadlife is not liable for the advice provided by Leadlife BV or one of the Leadlife Partners, printing and typographical errors on the Leadlife website or in the Leadlife Webshop.

6.2   The statutory warranty only applies to the Products of Leadlife, Leadlife BV and the Products of Leadlife Partners. The statutory warranty period for the Products that do not comply with the purchase order, the specifications stated in the offer, the reasonable requirements of soundness and/or usability and the statutory provisions and/or government regulations existing on the date of the conclusion of the purchase order, is two (2) years. Within this period, Leadlife and Leadlife BV reserve the right to replace the Products. If a replacement is not possible or disproportionate, Leadlife and Leadlife BV undertake to refund the payments received for the relevant Product.

If the Customer wishes to invoke its statutory warranty period with regard to Products of Leadlife Partners, the Customer must contact the Leadlife Partner in question via the Leadlife Partner contact details on the Partner page.

Upon delivery, the Customer undertakes to check that the quality and quantity of the Products correspond to the purchase order. Any complaint for visible defects or missing Products must be sent by email to customer service at info@leadlife.com , at the latest two (2) days after delivery. If the Customer fails to file a complaint within this period, the Customer loses its right to file a complaint for visible defects or missing Products.

To invoke the warranty, the Customer must be able to present proof of purchase or invoice. The warranty is not transferable. Any defect must be reported to the customer service of Leadlife and Leadlife BV via info@leadlife.com within two (2) months of its discovery . After that , any right to warranty expires. The customer service will indicate to the Customer which steps must be followed to return the Products. In any case, any return of the Products can only take place after prior written confirmation from Leadlife and Leadlife BV.

The warranty shall not apply to a defect resulting from: (i) fault or negligence of the Customer; (ii) repair or modification of the Product by the Customer or a Third Party; (iii) poor maintenance; (iv) careless use or use in abnormal conditions; (v) a cause inherent to the normal lifespan or service life of the Products; (vi) an external cause that cannot be attributed to Leadlife, Leadlife BV or a Leadlife Partner, (vii) fault, negligence or services of Third Parties.

Article 7. Right of withdrawal 

7.1    In accordance with Book IV of the Code of Economic Law, every customer, in his capacity as Consumer, has the right to cancel a purchase within a period of 14 calendar days after delivery of a Product or after entering into the agreement relating to the supply of Services or digital content.

         However, certain Products of Leadlife, Leadlife BV or a Leadlife Partner – specifically the Collection Kits – must be considered an exception to the right of withdrawal because the delivery of the sealed Collection Kit is not suitable for return for reasons of hygiene.

         All information regarding the right of withdrawal with regard to the activation of a subscription formula (Membership) can be read in the general terms and conditions of the Leadlife Application.

The Services of Leadlife and Leadlife BV must however be considered as an exception to the right of withdrawal because (i) the Customer has agreed to the start of the Services of Leadlife and Leadlife BV and (ii) the Customer acknowledges that he/she thereby loses his/her right of withdrawal. The Customer can therefore not claim a right of withdrawal with regard to the ordered Services of Leadlife and Leadlife BV.

7.2   By agreeing to these Terms and Conditions and completing the purchase in the Leadlife Webshop, the Customer confirms and accepts that he/she waives his/her right of withdrawal as soon as the Services of Leadlife and Leadlife BV are provided by Leadlife and Leadlife BV. This means that the Customer, from that moment on, is obliged to comply with these Terms and Conditions, without prejudice to the right to withdraw his/her consent for the processing of his/her Personal Data in accordance with the Privacy Statement.

7.3   Where the Services of Leadlife and Leadlife BV, the Leadlife Webshop or the website www.leadlife.com make use of Services, Products and Courses of Leadlife Partners, the terms and conditions of the relevant Leadlife Partner for the delivery of the Services, Products and Courses apply. By purchasing Services, Products or Courses from a Leadlife Partner, the Customer accepts the general terms and conditions of the relevant Leadlife Partners, an extract of which can be found on the Partner page. A reference to the full general terms and conditions of the Leadlife Partner in question will always be provided there. Leadlife accepts no liability for the content of the terms and conditions of Third Parties.

Article 8. Termination

8.1    All information regarding the termination of the subscription formulas can be read in the general terms and conditions of the Leadlife Application.

8.2    All information regarding the termination of a Service and/or a Trajectory can be read in the General Terms and Conditions of the Leadlife Application (this more specifically for Services and/or Trajectories of Leadlife BV) or also and/or in addition  with the foregoing in the General Terms and Conditions of the relevant Leadlife Partner.

Article 9. Liability

9.1    Leadlife makes reasonable efforts and uses all available resources to ensure that the Leadlife Webshop and the Services, Products and Courses offered therein are of high quality.

9.2    Leadlife performs a quality control on the supply of Services, Products and Trajectories of Leadlife BV and Leadlife Partners before these are available (whether or not for a fee) in the Leadlife Webshop. Leadlife will make every reasonable effort not to admit Leadlife Partners who do not deliver at least and with reasonable effort the same level of quality as the quality associated with the Leadlife Services, Products and Trajectories.

However, Leadlife is in no case liable if it appears that during the use of a Product of Leadlife BV or a Leadlife Partner or the execution of a Service or Trajectory of a Leadlife Partner, the quality of this Product or Service or Trajectory does not meet the specified quality. If the Customer notices that a Service, Product or Trajectory of Leadlife BV or a Leadlife Partner does not have the necessary quality or is executed with the necessary or expected quality, the Customer must first report this to Leadlife BV or, if applicable, the Leadlife Partner who are fully autonomously responsible for the delivery and supervision of their own Services, Products and Trajectories.

In addition, the Customer will do what is necessary to inform Leadlife of the defective quality determined by the Customer. Leadlife will make every reasonable effort to guarantee the quality of the delivered Product or the performed Service or Trajectory and will, if necessary, take the necessary steps to improve this quality in the future. Under no circumstances can any compensation be obtained via Leadlife for the defective quality of a Service, Product or Trajectory of Leadlife BV or a Leadlife Partner.

If Leadlife is informed of problems regarding a Leadlife Partner, or its Service, Product or Trajectory, Leadlife may, where appropriate, take the necessary steps to remedy this as quickly as possible.

9.3    Except and to the extent permitted by applicable law, Leadlife's liability under these Terms and Conditions in respect of any event (or series of related events) shall not exceed all fees paid by the Customer to Leadlife under the current Terms and Conditions of this Webshop.

9.4    Leadlife cannot be held liable in any way, contractually or extra-contractually, for the termination of the Services, Products or Courses of Leadlife BV and/or a Leadlife Partner. Leadlife is not liable in any way and for any data with regard to Services, Products and Courses of Leadlife BV and Leadlife Partners. All liability for Services, Products and Courses of Leadlife BV or Leadlife Partners therefore lies with Leadlife BV (in accordance with the limitation of liability included in these General Terms and Conditions) or the relevant Leadlife Partner.

9.5    Leadlife shall in no event be liable to the Customer for any indirect, punitive, special consequential or similar damages (including damages for loss of profits, loss of sales, loss or corruption of data, loss of customers and contracts, loss of goodwill, costs of procurement of substitute goods or services and damage to reputation, work stoppages, damage to programs or other data on computer systems, equipment, software or otherwise), regardless of whether such damages are the result of negligence, breach of contract, breach of statutory duty or howsoever arising. Each party has the duty to limit the damages. The limitations of liability under this article in favor of Leadlife shall have the same effect in favor of the subcontractors and Leadlife Partners.

The Leadlife Webshop contains hyperlinks to websites and/or pages of Leadlife BV, Third Parties and Leadlife Partners (including, but not limited to their licensors and other service providers), or may refer to them indirectly. Placing links to this website or pages does not imply in any way an implicit approval of the content thereof by Leadlife.

9.6   Leadlife makes efforts to keep the Leadlife Webshop accessible 24 hours a day, 7 days a week. Leadlife cannot be held liable in any way for the poor functioning, malfunctions or temporary or permanent unavailability thereof. The Customer cannot in any case claim compensation for any costs incurred or hold Leadlife liable for any form of damage that would directly or indirectly result from access to or use of the Leadlife Webshop. The content of the Leadlife Webshop can be taken offline, adjusted, changed or supplemented at any time, in whole or in part.

9.7    Any loss, material or physical damage that the Client may suffer due to the actions, omissions and/or medical advice of the Healthcare Practitioner and/or the (professional) Healthcare Practitioner within the therapeutic relationship with the Client, falls outside the scope of these General Terms and Conditions. They are governed by the applicable health law and the professional liability of the Healthcare Practitioner and/or the (professional) Healthcare Practitioner. Under no circumstances can Leadlife (or Leadlife BV) be held liable.

The Customer expressly acknowledges and agrees that his/her use of the Services of Leadlife and Leadlife BV, Products and/or Courses of Leadlife and Leadlife BV, including the analyses of its data, is entirely at his/her own risk.

Customer acknowledges and agrees that there are risks associated with transmitting information over and storing information on the Internet and that Leadlife is not responsible for any loss of Customer's Personal Data, including but not limited to the results reports and User Content related thereto.

9.8   Notwithstanding the foregoing provisions and to the maximum extent permitted by applicable law, Leadlife’s liability under or in connection with the Leadlife Webshop, Leadlife’s Services, Products and Courses under these Terms and Conditions, whether in contract law, warranty law, tort law or otherwise, is limited to the maximum amount payable under Leadlife’s mandatory insurance policy on the date on which the relevant liability claim arises. Nothing in these Terms and Conditions shall limit or exclude our liability for (i) gross negligence; (ii) wilful misconduct; (iii) fraud or personal injury.

9.9    Leadlife cannot be held liable for the correctness, completeness or accuracy of the information provided by a Customer with regard to the Services, Products and Courses.

Article 10. Suspension

10.1 If Leadlife, its licensors, Leadlife BV, Leadlife Partners and/or other involved service providers suspect that the Customer is in breach of these Terms and Conditions or any other instructions, guidelines or policies (including but not limited to the Privacy Statement) issued by Leadlife, the Customer's access to the Services, Products and Courses may be suspended or restricted. Such suspension will last until the Customer has remedied the breach that led to the suspension or restriction.

10.2  If the Customer does not pay the costs on time, if applicable, Leadlife can automatically suspend the Customer's access to the Services, Products and Trajectories of Leadlife and Leadlife BV as well as Leadlife Partners. The duration of this suspension is until the payment arrears have been made up.

Article 11. Intellectual property and usage rights      

11.1 All Intellectual Property Rights relating to the Leadlife Webshop, the Services, Products and/or Trajectories of Leadlife and any related software and/or additional documentation provided, belong to Leadlife and/or its licensors. Nothing in this  General Terms and Conditions shall result in a full or partial transfer of these Intellectual Property Rights to the Customer

11.2  All Intellectual Property Rights that can or will be exercised in respect of the Services, Products and/or Courses of Leadlife BV, any related software and/or additional documentation provided, wherever and whenever, belong to Leadlife BV and/or its licensors. Nothing in this General Terms and Conditions shall result in a full or partial transfer of these Intellectual Property Rights to the Customer.

11.3  Upon acceptance of the purchase order as described in these General Terms and Conditions, Leadlife grants to the Customer a non-exclusive, personal, non-sublicensable and non-transferable license to use the purchased Leadlife Services and Trajectories in accordance with these General Terms and Conditions.

11.4  Upon acceptance of the purchase order as described in these General Terms and Conditions, Leadlife BV grants to the Customer a non-exclusive, personal, non-sublicensable and non-transferable user license to use the purchased Services and Trajectories of Leadlife BV in accordance with these General Terms and Conditions.

11.5  The Client is not permitted to use the Services, Products and Courses of Leadlife and Leadlife BV for commercial purposes, unless with the prior written and explicit consent of Leadife or to use the Services, Products and Courses of Leadlife or Leadlife BV or any part of the foregoing, in a manner for which Leadlife has not given prior written and explicit consent. The Client shall use the Services, Courses and the Products solely in full compliance with (i) these General Terms and Conditions , (ii) any additional instructions or policies issued by Leadlife, including but not limited to those posted or placed within the Leadlife Webshop or on the Leadlife Website, (iii) all applicable laws and regulations and (iv) any additional documentation provided. Regarding the use of the Services, Products and Courses of Leadlife Partners, the Client shall comply with the general terms and conditions of the relevant Leadlife Partner as well as any additional instructions or policies issued by the Leadlife Partner.

11.6 The Customer undertakes not to, and shall not attempt to, directly or indirectly:

(i)    to reverse engineer, copy or modify any Services, Products and/or Courses and any related software, whether or not in whole or in part, back to the source code;

(ii)   to assign, sell, transfer, lease, rent, trade or encumber the Services, Products and/or Paths or any related software thereof, to make them available to any Third Party or to use the Services, Products and/or Paths or any related software thereof on behalf of any Third Party, except on the basis of express prior written consent of Leadlife or a Leadlife Partner regarding the Services, Products and Paths of a Leadlife Partner;

(iii)  to make or create derivative works based on the Services, Products and/or Routes or any related software thereof;

(iv)  to alter, remove, delete or obscure any copyright notice(s) or any other Intellectual Property Right notice(s), digital watermarks, proprietary legends or other notices in the Services, Products and/or Courses, in any related software thereof or in any additional documentation provided;

(v)  to intentionally distribute worms, Trojan horses, corrupted files or other items of a destructive or misleading nature or to use the Services, Products and/or Routes, in any related software thereof or in any additional documentation provided for any unlawful, invasive, infringing, defamatory or fraudulent purpose;

(vi) remove or otherwise circumvent any technical or other protective measures in the Services, Products and/or Routes, in any related software thereof or in any additional documentation provided;

(vii) use the Services, Products and/or Courses, any related software thereof or any additional documentation provided to generate unsolicited email advertisements or spam;

(viii) use any form of high-volume, automatic, electronic or manual process to access, search or harvest information in the Services, Products and/or Tracks, in any related software thereof or in any additional documentation provided (including without limitation robots, spiders or scripts);

Article 12. Right to complain 

12.1  The Customer can contact Leadlife regarding any objection regarding the Leadlife Webshop and – in general – the Services, Products and/or Courses offered therein or these General Terms and Conditions.

12.2  In the event of a dispute relating to the Leadlife Webshop or these General Terms and Conditions , Leadlife requests the Customer to contact it before taking any other step, so that the possibility of an amicable settlement can be explored.

12.3  In the event of a dispute relating to the Services, Products and/or Courses of Leadlife BV or these General Terms and Conditions , Leadlife BV requests the Customer to contact it before taking any other step, so that the possibility of an amicable settlement can be explored.

12.4 If an amicable settlement does not provide a solution, the Customer can contact the Federal Consumer Ombudsman Service.

Article 13. Processing of personal data and privacy   

Leadlife attaches great importance to the privacy of the Customer and respects the applicable GDPR with the relevant implementation laws when processing the Personal Data of the Customer. In the Privacy Statement, the Customer will find an explanation of how Leadlife obtains and processes their Personal Data.

Article 14. Force Majeure

14.1 Leadlife cannot be held liable for any damage suffered by the Customer as a result of a case of force majeure, being an unavoidable and unforeseeable cause or circumstance beyond the control of Leadlife or as otherwise defined in accordance with Belgian law.

14.2 If Leadlife or Leadlife BV invokes a case of force majeure, it will notify the Customer as soon as reasonably possible, at least in writing, of the force majeure, as well as of its estimated duration, and take all reasonable steps to limit the consequences of the case of force majeure. Leadlife will also notify the Customer when the case of force majeure has ended.

14.3 Even during a potential pandemic or other national or international crisis, Leadlife will make reasonable efforts to properly deliver the Services, Products and Trajectories of Leadlife and Leadlife BV. Regarding the Services, Products and/or Trajectories of a Leadlife Partner, the Customer must, where appropriate, contact the relevant Leadlife Partner. If the delivery of Services, Products and/or Trajectories is delayed or otherwise disrupted as a result of – even a partial result of – the potential pandemic, national or international crisis, Leadlife will not be liable to pay any damages, indemnities or fines to the Customer in respect of the failure to perform or the failure to properly perform the Services, Products and/or Trajectories of Leadlife and Leadlife BV.

Article 15. Transfer

15.1 Leadlife shall at all times have the right to transfer the Agreement with the Customer to any of its affiliated companies.

15.2 For the purposes of this Article, the following shall be considered affiliated entities: any entity that controls, is controlled by, or is under common control with Leadlife. 

15.3 For the purposes of this Article, control or control is deemed to mean the fact that Leadlife, directly or indirectly, has the power to direct or cause to be directed the management and policies of another entity through the ownership of voting securities, by contract or otherwise.

Article 16. Nullity

If any provision of these Terms and Conditions is declared invalid, void or unenforceable for any reason, the remaining provisions of these Terms and Conditions shall remain in full force and effect and the void, invalid or unenforceable provision shall be deemed to have been amended in such a way that it is valid and enforceable to the maximum extent permitted by law. 

Article 17. Remission 

Failure to enforce any provision of these Terms and Conditions shall never constitute a waiver of the rights and/or obligations under that or any other provision.

Article 18. Applicable law - competent court

These Terms and Conditions are exclusively governed by and must be interpreted in accordance with the applicable Belgian law, without giving effect to any conflict of laws or rules. The courts and tribunals of the judicial district of East Flanders, Ghent division, shall have exclusive jurisdiction in the event of a dispute relating to the Leadlife Webshop, the Services, Products and/or Trajectories of Leadlife or Leadlife BV or these Terms and Conditions. In the event of a dispute relating to Services, Products and/or Trajectories of Leadlife Partners, the Customer acknowledges that he must use the general terms and conditions of the Leadlife Partner as a starting point for resolving the dispute amicably, where appropriate to follow the correct agreements for submitting the dispute.
